Description
A temporary residence permit is a document that allows a foreign citizen or stateless person to live and work in the Russian Federation for 3 years. A temporary residence permit is issued in the form of a mark in the identity document of a foreign citizen, or in the form of a document of the established form issued in the Russian Federation to a stateless person who does not have an identity document. Obtaining a temporary residence permit is the first step in registering a foreign citizen for permanent residence in the Russian Federation (residence permit for a foreign citizen) or acquiring citizenship of the Russian Federation. A foreign citizen residing in the Russian Federation on the basis of a temporary residence permit has the following advantages: 1. Can freely enter and leave the territory of the Russian Federation. However, a foreign citizen cannot be absent from Russia for more than six months, otherwise the foreigner’s temporary residence permit may be cancelled. In this case, the total stay outside the Russian Federation for more than six months during the calendar year is taken into account (the exception is the impossibility of leaving the territory of a foreign state due to circumstances related to the need for emergency treatment, a serious illness of the foreign citizen, or the death of a close relative who lived with the citizen outside the Russian Federation due to official necessity). 2. Can legally work in the Russian Federation, he does not need to issue permits for carrying out labor activities, such as a patent or work permit. It is worth noting that labor activities can only be carried out in the subject of the Russian Federation in which the foreign citizen is allowed temporary residence. 3. Can register as an individual entrepreneur and officially engage in business. 4. Can obtain a temporary resident visa, allowing you to stay in Russia for three years without leaving (for citizens of countries that have a visa regime with the Russian Federation). 4. No later than 4 months before the expiration of the TRP, has the right to apply for a residence permit in the Russian Federation. A temporary residence permit is issued taking into account the quota approved annually by the Government of the Russian Federation, and can also be issued without taking into account the quota (if a foreign citizen has grounds that allow him to obtain a temporary residence permit in a simplified manner). A foreign citizen temporarily residing in the Russian Federation does not have the right to voluntarily choose his place of residence outside the boundaries of the constituent entity of the Russian Federation in whose territory he is permitted temporary residence.
Recipients
1. A foreign citizen or stateless person who has reached the age of eighteen and is lawfully in the territory of the Russian Federation, including with respect to a foreign citizen who is receiving a temporary residence permit in the Russian Federation together with him/her who has not reached the age of eighteen, or a foreign citizen who has reached the age of eighteen and has been recognized as incompetent or of limited capacity, of whom he/she is a parent, adoptive parent, guardian or trustee. 2. A foreign citizen residing outside the Russian Federation who has reached the age of eighteen, including with respect to a foreign citizen who is receiving a permit together with him/her who has not reached the age of eighteen, or a foreign citizen who has reached the age of eighteen and has been recognized as incompetent or of limited capacity, of whom he/she is a legal representative. 3. A citizen of the Russian Federation or a foreign citizen who has reached the age of eighteen, residing in the territory of the Russian Federation on the basis of a permit or residence permit, in relation to a foreign citizen who has not reached the age of eighteen, or a foreign citizen who has reached the age of eighteen and has been recognized as incompetent or of limited capacity, of whom he is the legal representative.
Required documents
To obtain a temporary residence permit, a foreign citizen shall submit: 1. An application in 2 copies. 2. 2 personal photographs, 35 x 45 mm in size, in black and white or color with a clear image of the face without a hat. Stateless persons shall submit five photographs, two of which shall be placed on the application, one on each copy. 3. A foreign citizen’s passport or other document established by federal law or recognized in accordance with an international treaty of the Russian Federation as an identity document of a foreign citizen. 4. A document issued by an authorized body of the state of permanent residence no earlier than 3 months on the date of filing the application, on the presence (absence) of a criminal record of the applicant. 5. A residence permit or other document issued by an authorized body of a foreign state, which confirms the residence of a foreign citizen outside the state of his/her citizenship. 6. Documents confirming that the foreign citizen submitting the application does not have drug addiction or infectious diseases that pose a danger to others, as specified in the list approved by the federal executive body authorized by the Government of the Russian Federation, as well as a certificate confirming that the applicant does not have a disease caused by the human immunodeficiency virus (HIV infection). 7. A document confirming the foreign citizen’s proficiency in Russian, knowledge of the history of Russia and the fundamentals of the legislation of the Russian Federation. Such documents include: a certificate of proficiency in Russian, knowledge of the history of Russia and the fundamentals of the legislation of the Russian Federation; a state-issued document on education (at a level not lower than basic general education), issued by an educational institution on the territory of a state that was part of the USSR before September 1, 1991; a document on education and (or) qualifications, issued to persons who have successfully passed the state final certification on the territory of the Russian Federation since September 1, 1991. If the application for a temporary residence permit is submitted to a foreign citizen under the age of eighteen or who has reached the age of eighteen and has been recognized as incapacitated or of limited capacity, the legal representative shall, among other things, submit: 1. Documents certifying the identity of the applicant and the person in respect of whom the application is submitted. 2. A document confirming the fact of birth registration, issued by the competent authority of a foreign state, if the application is submitted by one of the parents (adoptive parents), or a document confirming the powers of a guardian or trustee, issued by the competent authorities of a foreign state. 3. A document according to which the foreign citizen is recognized as incapacitated or of limited capacity, issued by the authorized body of a foreign state or the Russian Federation, if the application is submitted in respect of a foreign citizen,recognized as incompetent or of limited legal capacity. A foreign citizen to whom a temporary residence permit may be issued without taking into account the quota, as well as a legal representative in relation to a foreign citizen who is receiving a temporary residence permit jointly with him/her but has not reached the age of eighteen, or a foreign citizen who has reached the age of eighteen and has been recognized as incompetent or of limited legal capacity, to whom a temporary residence permit may be issued without taking into account the quota in accordance with paragraph 3 of Article 6 of the Federal Law “On the Legal Status of Foreign Citizens in the Russian Federation”, additionally submit documents confirming the grounds for obtaining a temporary residence permit in a simplified manner.
