Migration and registration of foreign citizens in the Russian Federation, extension of the period of temporary stay in the Russian Federation

Foreign citizens and stateless persons temporarily staying in the territory of the Russian Federation, as well as temporarily or permanently residing in the Russian Federation, are subject to migration registration at the place of stay and registration at the place of residence. Migration registration of foreign citizens in the Russian Federation is a mandatory procedure for every foreign citizen staying in the territory of the Russian Federation, regardless of whether he arrived with a visa or without a visa. Every foreigner who entered the Russian Federation must be registered at the place of stay for legal stay in the territory of the Russian Federation, i.e. notify the migration service of his arrival at the place of stay. Notification of arrival at the place of stay of a foreign citizen is submitted to the territorial body of the Ministry of Internal Affairs of Russia no later than 7 working days from the date of his arrival at the place of stay (except for cases stipulated by Federal Law of July 18, 2006 No. 109-FZ “On Migration Registration of Foreign Citizens and Stateless Persons in the Russian Federation” and international treaties). Foreign citizens and stateless persons who reside in the Russian Federation temporarily (with a temporary residence permit) or permanently (with a residence permit) and have the right to use residential premises located on the territory of the Russian Federation are subject to registration at the place of residence. The documents required for registration at the place of residence are submitted by a foreign citizen or stateless person directly to the territorial body of the Ministry of Internal Affairs of Russia at the location of the residential premises.

Recipients

1. Individuals or legal entities that are the host party of a foreign citizen or stateless person. 2. Foreign citizens or stateless persons permanently or temporarily residing in the Russian Federation, who have the right to use residential premises located on the territory of the Russian Federation and are subject to registration at the place of residence. 3. The legal representative of a foreign citizen who has not reached the age of 18 or has been recognized by the court as incapacitated (partially incapacitated). 4. Foreign citizens subject to registration at the place of stay in the cases provided for in parts 3, 3.1, 3.2 and 4 of Article 22 of Federal Law No. 109-FZ of July 18, 2006 “On Migration Registration of Foreign Citizens and Stateless Persons in the Russian Federation”.

Required documents

Migration registration at the place of stay: The host party provides to the territorial body of the Main Directorate for Migration Affairs of the Ministry of Internal Affairs of Russia in person, through the MFC or by mail: 1. Notification of the arrival of a foreign citizen or stateless person at the place of stay. 2. An identity document of a foreign citizen or stateless person. 3. A migration card or visa (if any). 4. A document confirming the right to use residential or other premises provided for actual residence to a foreign citizen, in the absence of information contained in the disposal of bodies providing public services, bodies providing municipal services, other state bodies, local government bodies or organizations subordinate to state bodies or local government bodies involved in the provision of state or municipal services. 5. An employment or civil contract of a foreign citizen with an organization or another document confirming that the foreign citizen is engaged in labor or other activities not prohibited by the legislation of the Russian Federation, as well as a letter from the head or other authorized official of the organization, whose signature is certified by the seal of the organization (if any). It should be noted that a person submitting an arrival notification to the territorial body of the Ministry of Internal Affairs of Russia, the MFC or by mail is required to present an identity document, except in the case of sending an arrival notification in electronic form. If the receiving party is an organization, the arrival notification to the territorial body of the Ministry of Internal Affairs of Russia is submitted (sent) by the responsible person of the organization, information about whom is indicated in the arrival notification. In this case, a copy of the document confirming the authority of the responsible person of the organization is additionally attached to the arrival notification submitted (sent) to the territorial body of the Ministry of Internal Affairs of Russia, including in electronic form. A foreign citizen or stateless person may register for migration purposes independently by submitting to the territorial body of the Ministry of Internal Affairs of Russia, through the MFC or the post office (if there are documented valid reasons preventing the host party from independently sending a notification of arrival to the territorial body of the Ministry of Internal Affairs of Russia): 1. An identity document. 2. Documents confirming valid reasons preventing the host party from independently sending a notification of arrival. 3. A copy of the identity document of a citizen of the Russian Federation (a foreign citizen or a responsible person of an organization) acting as the host party. 4. A migration card (not required in the event of exemption from the obligation to fill out such a card in accordance with an international treaty of the Russian Federation). 5. A copy of the document confirming the right of the host party to use residential or other premises,provided for actual residence to a foreign citizen. Registration at the place of residence: A foreign citizen permanently or temporarily residing in the Russian Federation, who has the right to use residential premises located on the territory of the Russian Federation, in order to register at the place of residence, submits to the territorial body of the Ministry of Internal Affairs of Russia at the location of the residential premises directly – in person, in electronic form, through the MFC: an application for registration at the place of residence of the established form (hereinafter – the registration application). 1. Application for registration at the place of residence of the established form. 2. Identity document. 3. Residence permit or temporary residence permit. 4. Documents confirming the right to use residential premises in accordance with the legislation of the Russian Federation (agreement, certificate of ownership or other document), and their copies.
